1. Introduction
Welcome to idesign4u.com.au (“the Website”). This Website is owned and operated by NINE EXPO PTY LTD (ABN: 79 606 993 962).
Please note that idesign4u and idesign4u.com.au are registered business and trading names entirely owned, managed, and operated by NINE EXPO PTY LTD. Any reference within these Terms to “the Company”, “we”, “us”, or “our” refers directly to NINE EXPO PTY LTD.
By accessing, browsing, or using this Website, or by engaging our design services, you agree to be bound by these Terms and Conditions. If you do not agree, you must cease using the Website or our services immediately.
2. Services, Orders, and Design Projects
- Accuracy: You agree to provide current, complete, and accurate project briefs, purchase information, and account data for all orders.
- Project Deposits: We require a non-refundable deposit of 50% (or an otherwise mutually agreed percentage specified in your project quote) before any strategic design work or asset creation commences.
- Revisions: Standard project quotes include up to three (3) integrated rounds of design reviews and revisions. Any additional alterations, structural layout modifications, or extra drafts requested beyond this threshold will be billed at our standard hourly design rate.
- Availability: We reserve the right to refuse service, limit project scales, or cancel any order or service contract at our sole discretion.
- Pricing: All prices are listed in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST) as registered. Prices are subject to adjustment without prior notice.
3. Australian Consumer Law (ACL)
- Guarantees: Our services and digital goods come with statutory guarantees that cannot be excluded under the Australian Consumer Law.
- Remedies: For major failures with a service, you are entitled to cancel your service contract with us and receive a refund for the unused portion, or compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods.
4. Intellectual Property and Copyright Ownership
- Website Ownership: All original content on this Website, including text, custom graphics, brand logos, code, layout designs, and software, is the explicit property of NINE EXPO PTY LTD and is protected by Australian and international copyright laws.
- Copyright Transfer: NINE EXPO PTY LTD retains full legal copyright and intellectual property rights over all draft concepts, layout treatments, and final design artwork until the client settles all outstanding project invoices in full. Upon receipt of final payment, legal ownership of the approved final artwork transfers entirely to the client.
- Portfolio Rights: Unless explicitly requested otherwise by the client in writing prior to project kickoff, we reserve the right to display completed design work, client logos, and project case studies within our professional digital portfolio, social channels, and on this Website for promotional purposes.
5. Limitation of Liability
To the maximum extent permitted by law, NINE EXPO PTY LTD is not liable for any direct, indirect, incidental, or consequential damages, loss of profits, or business interruptions arising from your use of, or inability to use, this Website, our digital assets, or our creative design services.
6. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales (NSW), Australia. You submit to the non-exclusive jurisdiction of the courts of NSW to resolve any operational disputes.
